164 TUCKER ENTERPRISES, INC. V. HARTJE, JUDGE [280 Cite as 280 Ark. 164 (1983) TUCKER ENTERPRISES, INC. d/b/a MR. MOBILE HOMES and CENTURION HOMES CORPORATION v. George F. HARTJE, Judge, et al 82-191 & 192 655 S.W.2d 426 Supreme Court of Arkansas Opinion delivered July 11, 1983 Petition to Correct Error; petition denied. Tom F. Lovett and John C. Gregg, for petitioners. Stephen E. James. for respondents. PER CURIAM. Respondent's Petition to Correct Error is denied. HOLT and PURTLE, J J., would grant. JOHN II. PURTLE, Justice, dissenting. I do not think the Lovettes should be required to pay the costs in this petition for prohibition. They were incorrectly named as respondents and appeared only to try to extricate themselves from the proceeding. The petitioners were successful in prohibiting the judge from hearing the case on its merits. Since we do
not require the trial court to pay the costs, although he lost the case, we should require the petitioners rather than innocent bystanders to pay the costs of this proceeding. HOLT, J., joins in the dissent.
