ARKANSAS SUPREME COURT No. CR 07-1340 Opinion Delivered February 5, 2009 CHRISTOPHER NEWTON WHITE PETITION FOR REHEARING Appellant [CIRCUIT COURT OF BENTON COUNTY, CR 2003-1001, HON. DAVID S. CLINGER, JUDGE] v. STATE OF ARKANSAS PETITION DENIED. Appellee PER CURIAM Now before us is appellants petition for rehearing. On December 4, 2008, this court affirmed the trial courts denial of appellants petition pursuant to Arkansas Rule of Criminal Procedure 37.1. White v. State, CR 07-1340 (Ark. Dec. 4, 2008) (per curiam). Appellant has failed to meet his burden of demonstrating entitlement to a rehearing pursuant to Arkansas Supreme Court Rule 2-3. In our opinion, we held that the arguments presented either had been previously raised at trial and were not cognizable in a Rule 37.1 petition, or failed to demonstrate entitlement to relief under the Rule. Appellant presented no error of law or fact in the decision that would merit a rehearing on the matter. Petition denied. Imber, J., not participating.
